Welcome to www.estage.com, the official website of ESTAGE, LLC, a South Dakota-based company located at 4800 S. Louise Ave #505, Sioux Falls, SD 57106 ("ESTAGE," "Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of our software platform and related services, including the ability to create websites, marketing funnels, social networks, live events, and manage various aspects of your online brand presence (collectively, the "Services").By accessing, subscribing, registering for, or otherwise using our Services, you agree to be bound by these Terms, along with our Privacy Policy and any additional terms applicable to specific Services. If you do not agree with these Terms, you must not use the Services.

IMPORTANT NOTICE:THESE TERMS CONTAIN AN ARBITRATION CLAUSE AND A WAIVER OF RIGHTS TO PARTICIPATE IN CLASS ACTIONS OR CLASS ARBITRATIONS. EXCEPT FOR CERTAIN TYPES OF DISPUTES MENTIONED IN THE ARBITRATION CLAUSE, YOU AND ESTAGE AGREE THAT ALL DISPUTES RELATING TO THESE TERMS OR YOUR USE OF OUR PRODUCT WILL BE RESOLVED BY MANDATORY BINDING ARBITRATION, WHICH MEANS THAT YOU WAIVE ANY RIGHT TO HAVE THOSE DISPUTES DECIDED BY A JUDGE OR JURY, AND YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

1. Definitions

"Platform" refers to the ESTAGE software and associated services."User" means anyone using or accessing the Services."Customer" refers to the end-users or clients served by a User."Content" means all data, designs, videos, and other media uploaded or created using the Platform.

2. Eligibility

You must be at least 18 years old and legally authorized to use the Services. If acting on behalf of a business, you represent that you have the authority to bind that entity to these Terms.

3. License and Access

ESTAGE grants a non-exclusive, non-transferable, revocable license to use the Platform. You may not copy, modify, reverse-engineer, or sublicense the software.

4. Account Registration

You must provide accurate account details and keep them secure. You are responsible for all activity under your account. Hosting services for multiple third-party clients using one account is prohibited without written permission.

5. User Responsibilities

You are solely responsible for your content and conduct. Prohibited uses include: Uploading illegal or infringing contentDistributing viruses or malicious codeUsing the platform for harassment or impersonation ESTAGE reserves the right to remove content or suspend accounts that violate this section.

6. Refunds for Physical Products

If ESTAGE sells physical goods (e.g., books, merch, etc.)You may request a refund must within 30 days of purchase, provided that:You submit a written refund request to support@estage.com. The product is returned promptly, following the shipping instructions provided to ESTAGE. The item is in like-new or reseallable condition, as determined by ESTAGE. Return shipping costs are your responsibility (unless defective). Refunds are not issued for returns made after 30 days.

7. Refund Policy for Digital Products & Subscriptions

Free Trials: If you do not cancel at least 24 hours before the trial ends, your subscription will automatically convert to a paid plan.

Monthly Subscriptions: No refunds are provided after the billing date. To avoid future charges, you must cancel at least 10 days before the next billing cycle.

Annual Subscriptions: Refunds are not issued after the billing date. If you cancel early, you may receive a credit toward other ESTAGE services but no cash refund.

ESTAGE reserves the right to adjust prices with notice.

8. How to Request a Refund

For eligible refunds, contact support@estage.com within the applicable time frame and include:

The email address associated with your ESTAGE account

The last 4 digits of the card used

The date and amount of the payment

For hard goods, you will receive return shipping instructions after your request is reviewed.

9. Chargebacks

Chargebacks without contacting support may result in immediate account termination.

10. Shipping Fees

Shipping fees for physical products will be calculated at checkout. Delivery timelines may vary. Risk of loss passes when the product is handed to the carrier.

11. AI-Generated Content

AI features are provided for content creation. You are responsible for verifying all output. ESTAGE disclaims liability for any harm resulting from AI-generated content.

12. Third-Party Integrations

ESTAGE integrates with external tools (email, payments, SMS, etc.). We are not responsible for performance or outcomes from these third-party services.

13. Messaging & Compliance

You are solely responsible for complying with CAN-SPAM, TCPA, and other messaging regulations. ESTAGE disclaims liability for misuse of communication tools.

14. Data Protection & Privacy

You are the data controller and must comply with GDPR, CCPA, and similar laws. ESTAGE acts as a processor. See our Privacy Policy for more.

15. Account Ownership

Accounts belong to the individual or entity who registered them. Disputes may require documentation. Accounts cannot be transferred without written consent.

16. Service Changes

ESTAGE may modify or discontinue features at any time. Continued use after updates implies acceptance.

17. Limitation on Claims

Any claims must be filed within 3 months of the incident or they are permanently waived.

18. Termination

We may suspend or terminate your account for any violation of these Terms, with or without notice.

19. Intellectual Property

ESTAGE owns all platform IP. You retain rights to your content but grant us a license to use it to provide the Services.

20. Warranty Disclaimer

The Services are provided “as is” and without warranties of any kind. We do not guarantee uptime or accuracy.

21. Limitation of Liability

We are not liable for indirect or consequential damages. Our maximum liability is limited to the amount paid to ESTAGE in the past 3 months.

22. Indemnification

You agree to indemnify ESTAGE against claims resulting from your use of the Services or breach of these Terms.

23. Dispute Resolution & Arbitration

All disputes shall be resolved through binding arbitration in Sioux Falls, South Dakota.

Class Action Waiver: No claims may be brought as part of a class action or consolidated arbitration.

24. Governing Law

These Terms are governed by the laws of the State of South Dakota.

25. Updates to Terms

We may revise these Terms from time to time. Continued use of the Services indicates acceptance of the latest version.
